Fair use or bio-piracy? Criteria for the fair and equitable benefit sharing for genetic resources in agriculture.
One main objective of the Convention on Biological
Diversity is the “fair and equitable sharing of the benefits arising out of
the utilization of genetic resources” (Art. 1). The aim of this PhD project
is to develop ethically sound criteria for benefit sharing in agriculture,
to give reasons for the necessity of a new international regime, and to make
suggestions for implementation in Guatemala as an exemplary developing
country. Existing legislation, new suggestions and available case studies on
access and benefit sharing for genetic resources will be evaluated, focusing
on their concepts of equitableness and justice. Fair negotiations will be
shown to be a crucial factor for international
justice.
